1. Acceptance of Terms

By accessing or using any services provided by Happy Brain Games ("we", "our", or "us") — including the website at happybrain.games, our games, and related applications — you agree to be bound by these Terms of Service and our Privacy Policy. These terms are accessible at all times via links in our site footer. Your continued use of our services constitutes ongoing acceptance of these terms. If you do not agree, please stop using our services immediately.

2. Description of Services

Happy Brain Games is a platform that provides puzzle games and related features. Our services currently include:

• Puzzle games with daily challenges and multiple difficulty levels
• User accounts with cross-game progress and authentication
• Leaderboards, statistics, and achievement systems
• Social features including friends lists
• Offline play capability through Progressive Web App (PWA) technology
• Optional Premium subscriptions for unlimited gameplay and additional features

2a. Subscriptions and Billing

Free and Premium Tiers

Our games are free to play with a daily puzzle limit. A Premium subscription unlocks unlimited puzzles, all themes, and additional features. Premium subscriptions are optional and available on a Monthly, 6-Month, or Annual basis.

Payment

Web subscriptions are processed by Stripe, Inc. Mobile subscriptions (iOS and Android) are processed through Apple's App Store or Google Play, respectively. By subscribing, you agree to the payment terms of the applicable payment processor.

Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You will be charged at the then-current price at the start of each renewal period. Prices may change with reasonable notice.

Cancellation

You may cancel your subscription at any time. Web subscriptions can be cancelled through your Happy Brain Games account page. iOS subscriptions must be cancelled through Apple's subscription management settings. Android subscriptions must be cancelled through Google Play. Cancellation takes effect at the end of the current billing period — you retain Premium access until then.

Refunds

Web (Stripe) subscription refunds may be requested by contacting support within 14 days of the charge. Mobile subscription refund requests must be submitted to Apple or Google directly, as those purchases are governed by their respective platform policies.

Cross-Platform Access

A Premium subscription grants access across web, iOS, and Android using the same Happy Brain Games account. Subscriptions purchased on one platform are honoured on all platforms when you are signed in to the same account.

Family Plan

The Family Plan (web only, billed monthly, every 6 months, or annually) allows the plan owner to invite up to 2 members, covering 3 players in total including the owner. Each invited member receives Premium access for the duration of the owner's active subscription. If the owner's subscription lapses or is cancelled, all member access ends at the close of the current billing period.

3. User Accounts

Eligibility

You must be at least 13 years old to use our services. By using our services, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these terms on your behalf.

Account Creation

You may use some features without creating an account. If you choose to register, you must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.

Social Login

You may sign in using third-party services such as Google, Discord, or Facebook. By doing so, you authorize us to access limited profile information as described in our Privacy Policy. Your use of third-party services is also subject to their respective terms.

Account Termination

You may request account deletion at any time. We reserve the right to suspend or terminate accounts that violate these terms, engage in cheating or abuse, or are used for any unlawful purpose.

4. Acceptable Use

You agree not to:

• Use automated tools, bots, or scripts to interact with our services
• Attempt to gain unauthorized access to our systems or other users' accounts
• Manipulate leaderboards, scores, or statistics through dishonest means
• Use our services for any illegal or unauthorized purpose
• Harass, abuse, or threaten other users
• Interfere with or disrupt the operation of our services
• Reverse engineer, decompile, or attempt to extract source code from our services
• Choose a username that is offensive, misleading, or impersonates another person

5. Intellectual Property

All content, design, code, graphics, logos, and other materials on our platform are owned by Happy Brain Games or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without written permission.

Your user-generated content (such as your username and profile information) remains yours. By using our services, you grant us a limited license to display this information within our platform (e.g., on leaderboards and friend lists).

6. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review it carefully.

7. Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or completely secure.

Game data, including scores, streaks, and achievements, is maintained on a best-effort basis. While we take reasonable precautions, we cannot guarantee that data will never be lost.

8. Limitation of Liability

To the fullest extent permitted by law, Happy Brain Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damage to reputation, arising out of your use of our services.

Our total liability for any claim related to our services shall not exceed the amount you have paid us in the twelve (12) months preceding the claim (which, for a free service, is zero).

9. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify users through our platform. Your continued use of our services after changes are posted constitutes acceptance of the revised terms.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be resolved in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of such courts.
